In January 2024, the IRS released the “8823 Audit Guide” for LIHTC properties, emphasizing that thorough documentation and due diligence were essential for protecting tax credits from audits. This webinar explored what due diligence entailed, how to document it properly, and how to demonstrate it to avoid losing credits. Attendees gained insights from real-world examples tested by state Housing Finance Agencies (HFAs) and the IRS, covering how to implement proactive policies and procedures to prevent tax credit loss, how to respond when noncompliance was cited by state HFAs, and how to document due diligence to reduce the risk of losing LIHTC credits.

Jen Brewerton is the Vice President of Compliance for Dominium. At over 40,000 units, operating in 25 different states, Dominium is one of the nation’s largest and most innovative affordable housing development and management companies. Dominium has added 7,000 units on average in the last 5 years through new construction and resyndication of existing properties, and is on track to do the same for 2025. Ms. Brewerton is responsible for determining and implementing all affordable program policy and procedures for Dominium. Prior to joining Dominium, Ms. Brewerton has held a variety of influential positions in her field, including almost 10 years with Texas Department of Housing and Community Affairs (TDHCA) overseeing the Housing Tax Credit, Bond, HOME and Housing Trust Fund programs. After leaving TDHCA, Mr. Brewerton held senior positions at CohnReznick, a Project Based Section 8 Contract Administrator and LIHTC consulting. Ms. Brewerton received her Bachelor of Arts degree from the University of Texas at Austin, and currently serves on the board of the Texas Association of Affordable Housing Providers
